ICE names and shames carrier with 100% OOS rate, 'illegal' driver

Immigration and Customs Enforcement arrested Maximo Garcia-Lopez, an “illegal alien from Guatemala,” after a crash in Marlborough, Massachusetts, hospitalized a child.

ICE took the unusual step of revealing the identity of the carrier Garcia-Lopez hauled for, YMY Transport LLC of Colonial Heights, Virginia. Data from Overdrive sister Fusable company Central Analysis Bureau revealed YMY is the owner of a 100% out-of-service rate.

Additionally, CAB shows that while YMY has an insurance policy on just one truck, recent inspections of three different trucks are on its record.

YMY’s address is a small residential home, and the company did not return Overdrive‘s request for comment.

ICE Boston arrested Garcia-Lopez Sept. 18, after he allegedly made an illegal turn “resulting in a crash with another vehicle that required a young child in that vehicle to receive emergency medical attention and be hospitalized,” the agency wrote.

The Department of Homeland Security’s Enforcement and Removal Office in Boston “later determined Garcia-Lopez does not have a commercial driver’s license or driver’s license.”

Two weeks prior, September 4, Garcia-Lopez had been caught in Connecticut without a CDL, a med card, or a logbook, according to CAB’s record of the inspection.

Troopers recorded four OOS violations that day, three for the driver and one for the underflated or leaking tires on the truck. Also: Four lighting violations, a brakes violation, a busted door, a damaged windshield and inoperable wipers.

ICE Boston said on Sept. 4 he was driving a 60-foot, 18-wheel tractor-trailer.

The day of the crash, Garcia-Lopez racked up a dizzying list of violations in a 2000 Freightliner.

DHS has recently ramped up its immigration enforcement efforts at weigh stations and on interstates after launching a joint task force with the Department of Transportation.

DHS has vowed to not only go after illegal immigrants, but the companies who employ them. YMY’s authority is active in FMCSA’s system, but publicizing the carrier may represent a new strategy from DHS.

Announcing its partnership with DOT, DHS focused largely on CDL schools, sweeping some 200 CDL schools and saying it had 1,000 leads for corrupt companies and DMV officials.

FMCSA has also done everything in its power to shut down CDL eligibility for non-citizens who aren’t permanent residents, but the arrest of Garcia-Lopez shows that some skip the CDL necessity altogether. Additionally, the arrest further illustrates that drivers who get put OOS don’t always actually stop driving.

In 2025, violation code 383.23A2LCDLN, or operation of a truck without a valid license, was the ninth most common driver violation with nearly 41,000 infractions across the U.S, according to FMCSA.

A check of Overdrive sister company RigDig‘s accounting for 2026 so far, with results current through last month and the first week of September, roughly, revealed more than 25,000 no-license violations had been recorded.
